NASA asks for help lassoing an asteroid, gets flooded with replies

NASA is reviewing public proposals for how to handle a hypothetical asteroid bound for impact with Earth.

The response comes after NASA announced last month that it has identified about ten thousand Near Earth Objects, that is, asteroids and comets that come within 28 million miles of Earth?s orbit. Just ten percent of those objects are large enough to causes substantial global damage to Earth ? bigger than about 100 feet wide ? and none of them are on an impact trajectory toward our planet.

Still, precedent suggests that we should be prepared: Most research still indicates that it was an errant asteroid that wiped out the non-avian dinosaurs at the end of the Cretaceous period, clearing the world of its million-of-years-in-the-making ecosystem packed with Brobdingnagian animals. That asteroid was about 9 miles wide.

And in the latest harbinger of what a massive asteroid impact could do to the Earth, a meteor exploded above?Chelyabinsk, Russia, in February, injuring about 1,500 people. NASA telescopes had not seen that meteor coming; the agency?s programs are largely focused on monitoring larger objects.

So NASA?s asteroid-mastering timeline is ambitious: NASA plans to have identified an asteroid target for snatching?at the latest in 2016. That asteroid will then be lassoed in 2019 and flung into a trans-lunar orbit in 2021. The agency also hopes to ferry humans to an asteroid as early as 2025, about five years before the projected date that astronauts are to land on Mars.?

The expensive plan???NASA had?asked for $17.7 billion?for?the fiscal year 2014, $105 million of which would go to the Asteroid Initiative???has been the subject of major discord between the House and the Senate. Earlier this month, the?House Committee on Science, Space and Technology passed a NASA authorization bill that would prohibit NASA from pursuing the?Asteroid Redirect Mission?without further clarifying its vague points.??At the same time, the Senate has proposed legislation that would authorize giving NASA $18.1?billion and a full go-ahead on the project.

Meanwhile, though, the asteroid plan is slowly rolling forward, and NASA wants ? needs, perhaps ? the public?s help. Last month, the agency announced a Grand Challenge,?an open call for proposals tackling some of the most vexing questions in astroengineering, for its Asteroid Initiative.

And the response has been enthusiastic. About a month into the challenge, NASA has received some 400 submissions proposing possible asteroid targets and means of nabbing them. The applications are now under review for possible incorporation into the agency?s plans.

Earth has some built-in asteroid deflection techniques of its own, but our atmosphere protects us from asteroids smaller than about 130 feet in diameter, roughly the length of the long-necked dinosaur, Argentinosaurus huinculensis.

The Rise of the Apple TV: What should be Apple's next step?

The Rise of the Apple TV

Frost & Sullivan recently reported that Apple TV made up more than half of the streaming device market for 2012, beating competitors like Roku and TiVo. Not bad for something that Steve Jobs once referred to as "a hobby" for the company. What should be Apple's next step for the little black box?

First, let's put that news into some context. The Apple TV is the most popular streaming box out there, according to this report - and that's a device that Apple doesn't separately report in its quarterly revenue figures. In fact, the Apple TV's contribution to Apple's balance sheet this past quarter is buried in the "Accessories" portion of its quarterly statement, which for the most recently reported quarter was $1.18 billion (out of $35.23 billion in total revenue).

Compared to the gargantuan revenues of the iPhone ($18.15 billion), the sizable revenues of the iPad ($6.37 billion), or even the Mac ($4.89 billion), that Accessories number is pretty small - especially when you consider that it includes all other Apple-branded hardware peripherals, and accessories made for iPhone, iPad and iPod touch.

But Tim Cook did offer details earlier this year that may give some insight about the success of the Apple TV. In May, Cook said that Apple has sold 13 million Apple TVs to date. About half of those were sold within the previous year, Cook revealed.

That's an average of almost 1.63 million Apple TVs sold each quarter. At $100 a piece, that's $163 million in Apple's coffers from Apple TV each quarter. Some quick back of the envelope math suggests that Apple TV is contributing a little less than 14 percent to Apple's overall "Accessories" revenue numbers. Small potatoes for Apple's balance sheets, perhaps, but if Frost & Sullivan's analysis is correct, a huge chunk of the streaming box market. Apple's biggest competitor, Roku, grabs less than half the remaining pie, according to the report. Other competitors divide what remains into even smaller slivers.

The Apple TV has been around for six years and is already in its third hardware generation. Apple doubling its installed base of Apple TVs in the last twelve months certainly indicates that public momentum for the device is picking up.

But the overall small numbers demonstrate just how nascent the streaming box market really is. While many of us Apple enthusiasts have bought Apple TV, there are still a huge number of consumers who don't find the device particularly useful or interesting, or feel that their TV viewing needs are serviced well enough by cable TV, DVRs and other set-top devices.

Apple's gobbled up a huge piece of a very small pie. But that small market is growing.

Where does Apple go from here?

The second and third generation Apple TV - the small black box - lacks any sort of local storage capability, but makes up for it by being more programmable than its predecessor. Not only is it easily updatable with firmware improvements and other enhancements, but it can be programmed with entirely new apps.

In mid June, Apple rolled out an update for the Apple TV that added support for several new content services including ESPN, HBO, subscription-based anime service Crunchyroll and more.

Some analysts and pundits hope to see the Apple TV become a disruptive technology for television watching - something that people could use in place of cable television altogether. And indeed, some Apple TV users find the content from iTunes, Netflix, Hulu and the other services the Apple TV supports to be sufficient for their viewing habits.

But it's clear that Apple is taking a more iterative approach with the device - an approach that requires customers to have other media at their disposal. Take HBO Go, for example. The app works the same way on the Apple TV that it does on the iPhone and iPad - you can stream HBO content, including current and archived TV series, but it requires you to validate by entering your cable service provider account information first. You can't subscribe to the service a la carte, as it were.

Tim Cook describes a "grand vision" for the Apple TV and calls television itself an "area of intense interest" for the company, but so far he hasn't publicly articulated what that vision is.

According to Frost & Sullivan, the secret to the Apple TV's success is AirPlay, which enables iOS devices and Macs to stream audio and video content to the Apple TV. AirPlay is the killer app for the Apple TV, because it enhances the experience of users of other Apple products by making it easier for them to share content on their television.

Apple implicitly understands this - the company's executives have spoken for years about the "halo effect" of people buying one Apple product and having a great experience with it, then that driving their purchase of more Apple hardware. To that end, AirPlay is getting a big boost in OS X Mavericks, due out later this year. Apple TV owners can already mirror the Mac's display to their television. But with Mavericks' improved Multiple Display support, Mac users will be able to use an Apple TV-connected television as a completely independent display.

The television question

Analysts like Gene Munster have long prognosticated that Apple will build an actual television, but the economics of doing so don't make a lot of sense, at least not right now. Flat panel TVs are an increasingly commodity-drive market, with inexpensive Chinese manufacturers flooding the market with cheap sets you can buy at Walmart and Target.

There may be a window for some new brands to be established in the Ultra HDTV market - the new 4K sets that are coming out. Apple could leverage its legendary supply line muscle with Chinese manufacturers to produce 4K televisions.

And Apple does appear to be making a play for 4K on some of its hardware, like the new Mac Pro, which will feature Thunderbolt 2 interfaces capable of driving 4K resolution displays. But that's a technology that is squarely focused on the high end of Apple's Mac line at the moment, and for the Mac Pro that makes a lot of sense: it's a machine that's historically had a high penetration in the professional digital video and film editing market.

But what, ultimately, would an actual Apple television - 4K or otherwise - gain Apple in the long run? It could establish itself as a niche player - a high end boutique brand, perhaps, but could it muscle itself onto store shelves the same way that competitors like Samsung, LG and Vizio, or long-time players in the field like Sony and Panasonic, have?

Stay the course

It's a smarter play for Apple to continue to to refine the black box with software updates, then roll out a new generation as it makes sense with new features like UHDTV support as it becomes something more consumers are looking for.

While more and more televisions are coming from the factory with "smart" capabilities like connecting to the Internet and to services like Netflix, many consumers continue to use them as simple dumb terminals for their set top boxes and their streaming devices.

For as long as that's the case, Apple's best strategy for the Apple TV remains building a black box that can connect to any of them, instead of building its own branded television. Compared to a television, the Apple TV is almost an impulse buy, and it capitalizes on the halo effect that continues to drive consumers to new Apple products.

Discovery of New Molecule That Aids in Suffocating Tumors can be Used in Development of New Cancer Drugs


Cancer Research UK scientists at the University of Southampton found that this molecule targets the master switch, HIF-1, that cancer cells use to adapt to low oxygen levels, a common feature in the disease.

The researchers uncovered a way to stop cancer cells using this switch through an approach called 'synthetic biology'. By testing 3.2 million potential compounds, made by specially engineered bacteria, they were able to find a molecule that stopped HIF-1 from working.

All cells need a blood supply to provide them with the oxygen and nutrients they require to survive. Cancer tumours grow rapidly and as the tumour gets bigger it outstrips the supply of oxygen and nutrients that the surrounding blood vessels can deliver.

But, to cope with this low-oxygen environment, HIF-1 acts as a master switch that turns on hundreds of genes, allowing cancer cells to survive. HIF-1 triggers the formation of new blood vessels around tumours, causing more oxygen and nutrients to be delivered to the starving tumour, which in turn allows it to keep growing.

Dr Ali Tavassoli, a Cancer Research UK scientist whose team discovered and developed the compound at the University of Southampton, said: "We've found a way to target the steps that cancer cells take to survive and we hope that our research will one day lead to effective drugs that can stop cancers adapting to a low oxygen environment, stopping their growth. The next step is to further develop this molecule to create an effective treatment."

Dr Julie Sharp, senior science information manager at Cancer Research UK, said: "Finding ways to disrupt the tools that cancer cells use to adapt and grow when starved of oxygen has been a hot topic in cancer research, but finding drugs that do this effectively has proved elusive.

"For the first time our scientists have found a way to block a master switch controlling cells response to low levels of oxygen -- an important step towards creating drugs that could halt cancer in its tracks."

Apple is rumoured to be using newer screen technology for the next iPad in an effort to slim the design even further

Apple is rumoured to be looking at an even thinner design for the next iPad thanks to advanced screen technology that was first introduced with the iPad mini.

Longtime rumour-spinner Digitimes has indicated that the "GF2" thin-film touchscreen technology used in the Apple iPad mini will be making its way into the iPad 5 when it arrives later this year.

What that means is we could see the new iPad measuring as much as 20 per cent thinner thanks to the screen tech. And, although it's expected that Apple will keep the same 9.7-inch form factor, the bezels will be noticeably slimmer.

According to sources speaking to Digitimes LG Display, Samsung Display and Sharp are all in the picture when it comes to supplying Apple with Retina display technology for both the new iPad and iPad mini models.

The sources also state there is an internal debate going on inside Apple as to whether fitting the next iPad mini with a Retina display will cannibalise sales of the iPad itself.

Whether or not these rumours prove accurate remains to be seen. We've got our fingers crossed for an October or November reveal of the next iPad so, hopefully, we won't have too long to wait.

FRANCE: Insulting French president no longer an offence

Being rude to the French president is no longer an offence after parliament agreed on Thursday to amend legislation dating back to 1881 in favour of freedom of speech.

Whereas before any rude remark risked an automatic fine for ?offending the head of state?, the president is now reduced to the same category as ministers and parliamentarians and would need to have a judge prove there had been slander or defamation.

MPs and senators voted unanimously to do away with the law in order to meet European standards. France?s Socialist Party, which proposed the change, described the law as ?unjustifiable in a modern democracy?.

The offence, which was introduced in 1881 under press freedom regulations (ironically), was punishable until the year 2000 by a jail sentence of between three months and one year.

During General Charles de Gaulle?s tenure, six people were convicted of the offence, but its use had dwindled in recent decades.

?Get lost Sarkozy?

The change came after the European Court of Human Rights (ECHR) ruled in March that France had violated a demonstrator?s right to freedom of expression when it fined him for holding a banner up to Nicolas Sarkozy reading: ?Get lost, jerk.?

That slogan was made famous in France by the former president himself, when he insulted a visitor at an agricultural fair in 2008. The man refused to shake the then president?s hand, resulting in Sarkozy?s vulgar reaction, a video of which went viral. The court in March judged that left-wing activist Herv? Eon, whose banner used the same expression in addressing the president, was being satirical.

The court said his conviction and 30 euro ($40) fine were out of proportion to his protest and that his right to freedom of expression had been violated.

Anyone found by a judge to have slandered the president still runs the risk of a fine of up to 45,000 euros, but only once the matter has been resolved in court.

President Fran?ois Hollande has so far shown a thick skin to insults from the public, despite a string of unkind nicknames such as ?Flamby?, a brand of wobbly caramel pudding and ?Mr Little Jokes?.

Congressman?s comments anger South Florida colleagues

Miami?s three Cuban-American members of Congress have a message for fellow U.S. Rep. Steve King, who said more DREAMer immigrants are drug mules than valedictorians: Be quiet.

King?s statements, which drew swift rebukes from Republican congressional leaders earlier in the week, have become the latest flash-point in the immigration debate in the conservative House, which is divided over whether and how to reform the system.

?These comments are outrageous and reflect only this particular member?s views,? Ileana Ros-Lehtinen, a Republican House member like King, said in a statement. ?Such statements are factually untrue, hurtful and seem designed to divide rather than to bring our nation together.?

Ros-Lehtinen?s fellow Miami Republican, U.S. Rep. Mario Diaz-Balart, has spent more than a year with a bipartisan House group that now plans to release a comprehensive immigration-reform package after the August recess ? a strategic move partly designed to shield the bill from criticism when Congress isn?t in session.

Diaz-Balart called King?s comments ?unacceptable? unacceptable. Unacceptable.?

U.S. Rep. Joe Garcia, a Democrat, said at a House Judiciary subcommittee Tuesday that King?s sentiments were ?beneath the dignity of this body.?

But King isn?t backing down, and the conservative news media is celebrating his comments about the so-called DREAM Act, which would give a pathway to citizenship for students who were illegally brought to this country by their parents.

While DREAM Act supporters say eligible kids are current and future valedictorians, King told the conservative media outlet NewsMax last week that some are used as drug mules.

King took to the House floor late Wednesday night and defended himself by reading comments into the congressional record that included information from a 2012 Associated Press article that bore the headline: ?Mexico Children Used as ?Mules? by Drug Gangs.?

According to The Hill, King also reiterated a version of his NewsMax comments that caused a stir: ?For everyone who?s a valedictorian, there?s another 100 out there that they weigh 130 pounds ? and they?ve got calves the size of cantaloupes because they?re hauling 75 pounds of marijuana across the desert. Those people would be legalized with the same act.?

Most polling indicates that most voters, including a plurality of Republicans, favor the DREAM Act and a broader pathway to citizenship.

But the polls don?t account for the gerrymandered-nature of U.S. House districts, where a large majority of Republicans represent districts with small Hispanic populations.

Ros-Lehtinen and Diaz-Balart?s districts are among the few exceptions.

The more-moderate Senate passed a comprehensive immigration-reform plan in June that provides a pathway to citizenship, beefs up border security and offers incentives to attract more high-skilled immigrants.

But many House Republicans say it?s not enough. They want more border security faster before an ?amnesty? of any sort is given to current illegal immigrants.

Meantime, many conservatives have turned on a key sponsor of the bill, Florida Sen. Marco Rubio, a potential GOP presidential contender who would have to campaign in King?s home state of Iowa should he run for the White House in 2016.

With such vocal Republican opposition, polling indicates that voters generally and Hispanics in particular would be more likely to fault the GOP if an immigration-reform bill doesn?t pass the House.

Voters are also not sure about the sincerity of Republicans when it comes to immigration reform, according to a new Wall Street Journal/NBC poll. It found that 59 percent of voters think Republican calls for more border security are an ?excuse to block reform.? Only 36 percent said it was a ?legitimate concern.?

Democrats are again starting to campaign on the issue, and on King?s comments in particular.

Garcia issued a campaign statement Wednesday highlighting his comments in committee where he took King to task.

?When members of this committee ? when members of this House ? use inflammatory language, use offensive language, it does not help the process,? Garcia said.

?It is offensive. And it is beneath the dignity of this body and this country,? Garcia said. ?This is an American problem. And we need to work together.?

Apple's developer center comes back online after weeklong overhaul

While most of you are fixing to shut things down for the weekend, Apple's developer portal is waking up after a weeklong hiatus. If you'll recall, Apple affirmed that its dev center was hacked last week while simultaneously announcing a system overhaul. Now, however, things seem to be back in action, with little to no consumer-facing changes to the site itself. If we had to guess, we'd say the bulk of the tweaks have happened behind the scenes. With that, we invite you to return to your regularly scheduled coding.

Furniture company sticking with Paula Deen

HIGH POINT, N.C. (AP) ? The North Carolina-based home furnishings company that markets Paula Deen's furniture line is sticking with the embattled celebrity chef.

The High Point Enterprise (http://bit.ly/1c5x4fY ) reports that Universal Furniture International will continue to market the Paula Deen Home Collection.

Deen has been under fire since the revelation earlier this year of a legal deposition in which Deen admitted under oath to having used the N-word. Many companies have dropped Deen since the deposition became public.

Jeff Scheffer with Universal Furniture says he feels bad for Deen. He says the Deen he knows isn't the one who has been portrayed in the media recently.

Scheffer wrote retailers saying his company accepts Deen's apologies for her previous comments. He says part of the decision is based on retail customer feedback.

(AP) ? Chinese, North Korean and two U.S. veterans on Thursday joined leader Kim Jong Un at the start of official commemorations in Pyongyang for the 60th anniversary of the end of the Korean War.

In his first public appearance for the anniversary events, Kim laid a floral arrangement at a monument to war veterans that is the centerpiece of a sprawling new national military cemetery in Pyongyang's outskirts. Kim took power after his death of his father, Kim Jong Il, in late 2011 and has overseen two long-range rocket launches and a nuclear test that have drawn international condemnation and tightened U.N. sanctions.

Dozens of elderly Chinese soldiers who fought for North Korea joined Thursday's commemoration. Also taking part: two U.S. veterans who fought against Chinese soldiers at the Chosin Reservoir in November and December 1950.

"I would like to meet some (North) Korean veterans to tell them how sorry I am for their fallen comrades, and for my fallen comrades," said retired Pvt. First Class Dick Bonelli of the U.S. Marines.

Bonelli and U.S. Navy Capt. Thomas Hudner are in North Korea to revisit Jangjin County, better known to Americans as the Chosin Reservoir.

"It's a very emotional occasion to be here with so many veterans ? not only the veterans but also the people of the nation who turned out to show their support to all of veterans. And as an American veteran, I am delighted to see that our former foe and we share some of the same feelings about this," Hudner said.

The Korean War, pitting North Korean and Chinese troops against U.S.-led United Nations and South Korean forces, ended with an armistice on July 27, 1953. A peace treaty was never signed, leaving the Korean Peninsula in a technical state of war and divided at the 38th parallel.

That has not stopped the North Koreans from calling July 27 "Victory Day." Brightly colored banners with the words "Victory" and "War Victory" fluttered from buildings across the capital city. The North Korean government is expected to use the anniversary to rally support for Kim and to draw attention to the division of the Korean Peninsula.

In February, North Korea conducted a nuclear test, raising tensions in the region amid threats of war between the two Koreas that led to the shutting down of a jointly-run factory park in a North Korean border town.

Officials from the rivals have had a series of so-far unsuccessful meetings this month to reopen the park and are set to meet again on Thursday, their sixth discussion this month.

North Korea has been gearing up for months for the milestone war anniversary. Soldiers were assigned to carry out an extensive renovation of the Korean War museum. Students rehearsed every afternoon for a new war-themed rendition of the "Arirang" mass games song-and-dance performance, which opened Tuesday. And citizens got down on their hands and knees in the lead-up to help lay sod and plant grass as part of a massive greenification of Pyongyang.

The anniversary is taking place as North Korea copes with flooding from the seasonal monsoon rains that strike the peninsula every July. Eight people were killed, more than 4,500 homes destroyed and 17,700 left homeless this week, according to the official Korean Central News Agency.

Scores of foreign visitors began arriving in Pyongyang this week, including a planeload of journalists from the U.S., Japan, China, Russia and elsewhere.

One North Korean, Pak Chun Son, sobbed as she paid her respects at the gravestone of her father, Pak Hyon Jong, who died in the war when she was 5.

"My father will be honored on this hill forever," said her brother, Pak Yun Yong, who was 8 when his father died. He was dressed in a military uniform weighed down by medals. Tears sprang to his eyes. "We want to raise our children to be patriots like their grandfather was."

Commemorations also are taking place in South Korea and the United States.

South Korean President Park Geun-hye attended a memorial event Tuesday in the southern city of Busan to pay her respects to the troops who defended South Korea during the war. On Thursday, a group from South Korea's Naval Academy set sail on a six-month expedition to 14 countries as part of their Korean War remembrance.

U.S. President Barack Obama is to give a speech Saturday at the Korean War Veterans Memorial in Washington.

Liberty and tradition for Rome?

Hello CivFanatics, I'm wondering if those two trees could work for Rome because it's ability favors going wide, but with having a powerful capital. There's a couple of specifics I'm not sure on:

1: Does the wonder boost from Aristocracy apply to all cities? If Rome is always building buildings another high production city might be a good idea for wonders.

2: Does Oligarchy apply to all cities? A couple of times when my main army is of fighting on one side I get backstabbed on the other side of the empire, having free units everywhere would be great.

3: In BNW I sometimes end up struggling for money at the start, starting off with Tradition up to Landed Elite and Monarchy might help me find my feet before expanding. Then maybe go straight to Collective Rule and start expanding.

4: If I can't generate enough faith from starting small, could I use Liberty's great person to spawn a prophet to found a religion and pantheon at the same time? How likely is it that you'll get locked out of a religion with all f the Civs taking Piety now? If not I guess it makes more sense for Rome to take someone else's religion anyway.

5: How does the glory of Rome stack with other production bonuses like the Piety opener (half-speed for shrines), or Aesthetic's Cultural Centre (50% faster).

6: Could it be a good idea for a empire to go wide with policies too, and buy those production boosting policies, more faith from Organized Religion, cheaper roads with Trade Unions etc, but actually completing relatively few trees?

Edit:

7: If I'll be getting that free settler much later would it be a good idea to build one before then? Or would having one super capital be good enough until expanding with Collective Rule?

8: Use Legalism for a free monument in the capital? Or build one before hand to get the free amphitheatre?

3-D Printed Jets Mimic Octopus Propulsion

An octopus spends most of its time crawling around on the seafloor looking for dinner?and trying to avoid becoming it. But when it needs to make a quick move, it can switch into overdrive and jet away. To do this, it sucks water into its mantle and then quickly expels it through a funnel. The funnel helps to act as a steering mechanism and can be pointed to direct the octopus?s flight.

Although a pretty basic concept?squid use it, too?we humans have been slow to build anything quite like it. Our underwater propulsion systems are primarily continuous in their power (think propellers and even jet skis and boats). But there are some advantages to this discontinuous system. It?s powerful, efficient and stealthful.

Now, a team of researchers at the Fraunhofer Institute for Manufacturing Engineering and Automation in Germany has developed a working prototype for this octopus-inspired propulsion. And it can be 3-D printed in flexible plastics.

The system is composed of four elastomer balls that contain valves and pumps to control the flow of water internally. Water enters one of the chambers and, after being sealed in by a valve, the surrounding structure is collapsed by a piston?much like the squeeze of an octopus?s mantel to shoot water out of the funnel. ?The system is simple, but effective,? Andreas Fischer, an engineer on the project, said in a prepared statement. ?When they use it, the octopods can speed up considerably over short distances.?

Researchers at the Octopus Integration Project, which is on its way to building an entirely soft-bodied robotic octopus, are also working on the propulsion problem. When I visited the lab in 2011, Francesco Giorgio-Serchi, a postdoctoral fellow at the Center for Sea Technologies and Marine Robotics at Scuola Superiore Sant?Anna in Italy, showed me how they were going about the process. Because they are aiming to replicate the octopus more faithfully, they were actually working with silicone casts of octopus mantles rather than more abstracted shapes. This model is more complex to build?and work with?but it allows them to study the fluid dynamics that octopuses use, such as the vortex ring, in more detail.

The new squeezable jets constructed by the research team in Germany are certainly simpler to make. Melted thermoplastics are fed into 3-D extruders and then each shape is printed from the bottom up. The result is a flexible, scalable component that can withstand high pressures without permanently deforming. Kind of like the octopus.

Samsung, Apple reportedly in talks to settle patent war

Negotiations between Apple and Samsung had reportedly begun since late last year.

Samsung Electronics is reportedly in negotiations with Apple for a cross-licensing deal to end their patent dispute.

The Korea Times reported on Monday, citing industry sources familiar with the matter, Samsung is trying to iron out differences over key issues ahead of a new trial in the U.S. federal circuit slated for November.?

One of the sources said talks had begun since late last year, and has "come down to the issue of fees for Apple".

The Cupertino-based company reportedly holds the key to whether both companies will reach a compromise or continue to fight as Apple's request to the U.S. International Trade Commission (USITC) for a stay of remedial orders such as an import ban or cease and desist was rejected.

"Both companies are now finding better conditions to bring the settlement talks on their sides. That?s why they are paying keen attention to two upcoming separate decisions by the USITC," one of the sources, said in the report.

The USITC in June had banned Apple from importing some of its devices including iPad 2 and iPhone 4 because it infringed some of Samsung's patents. The final decision will be announced on August 1, 2013 after a 60-day review, on whether Samsung infringed on Apple's patents.

Apple had taken Samsung to court in 2011, alleging Samsung infringed patents of its iPhones and iPads, and the jury's verdict was that Samsung should pay US$1 billion. Other than the U.S., both companies have also been engaged in patent wars in Germany, France, Japan and Italy.

Just earlier this month, Samsung entered another cross-licensing deal with SK Hynix for the next five years, to have full access to each other's memory chip patents.

The recently released Swell Radio is unofficially billed as "Pandora for radio," and after using it for several hours, I understand why. The free iPhone?app lets users stream news, comedy, sports, and business content to their Apple iPhones?content that adapts to your listening habits to create a customized experience. Fans of news, podcasts, and talk radio should consider giving Swell Radio a download.

Tuning In
Unlike Stitcher Radio (an app that provides a similar service), Swell Radio doesn't require you to create an account?you can jump right in. Swell Radio sports a simple but elegant interface that's remarkably clutter-free. Swell Radio utilizes "audio cards," rectangular panels that contain important information such as the show/station/podcast's name, runtime, and the broadcast date. There are also two icons that let you rewind a track in 10-second intervals or fast-forward in 30-second intervals. Tapping the small information icon flips the audio card where you can find a show synopsis and a link to the show's homepage.

NPR, Comedy Central Stand Up, and BBC Documentaries are just a handful of the many stations available. The audio streamed to my Sony MDR headphones was crisp and clear; in fact, Swell Radio sounded better than many terrestrial radio stations, as there were no pops or hisses. If you dig into the settings, you can find an option to for "high-quality streaming" that's designed to improve audio (when a show offers it).

Listening In
Brining a finger to the Swell logo opens a genre listing that includes technology, business, arts, TV& film, culture, music, comedy, and other categories. Selecting music took me from the informative Freakonomics show to a program that featured several indie artists. Switching categories causes Swell Radio to play a handful of the new genre tracks, before reverting to the normal mixed-content stream. Unlike Stitcher Radio you cannot ban or favorite shows.

Note: Swell Radio doesn't let you continuously listen to one topic or genre, as some other music streaming apps do. For example, if I fired up Slacker Radio's '80s station, I'd be fed nothing but tunes from the decade of decadence. Swell Radio, on the other hand, streams a variety of topics that are constantly tweaked based on several criteria. Swell Radio also doesn't offer live radio, which is SiriusXM Radio's bread and butter. Instead, it has timely recorded programming; I listed to Grantland's Jalen Rose Report podcast just hours just a few hours after it went live.

Like Slacker Radio and many other audio streaming services, Swell Radio constantly tweaks the listening experience based on your actions?it's not a traditional podcast. The app knows what you like based on how long you listened to a particular genre, when you skipped a program, the "wisdom of the Swell community," data from your Twitter stream (if you follow lots of sports teams, Swell Radio serves up more sports content), time of day, and the time since last fired up the app. You can also share content via Facebook, Twitter, and email. Swiping up on an audio card bookmarks a track, so that you can return to it at a later time.

Radio Days
There is a sea of iPhone apps designed to stream music, but very few have a laser-beam focus on news and talk. Swell Radio is impressive, but not strictly because of the novel idea; it's an app that iPhone users should download if they dig non-music radio and podcasts. Should developer Concept.io allow users to continuously stream their genres of choice (a feature that Stitcher Radio offers), this already impressive app will be that much better.

Kanye West, known for his disdain of paparazzi, allegedly scuffled with a photogpraher outside LAX?Friday.

A witness said a paparazzo named Dano provoked the musician and new father who landed at Los Angeles International Airport earlier Friday.

"He wanted to record something and nothing was happening," witness Shamir Chantre said. "Maybe he wanted to get some action going on."

  • Paparrazo: "Can we talk to you? Why can't we talk to you?"

In the video, posted by TMZ, Dano tells Kanye, who is known for his dislike of paparazzi, that he doesn't want a fight, but Samir Chantre said that's exactly what it appears he wanted.

"I think he looked for it and he got it," the witness told NBC4.

Chantre had just returned from a vacation in Brazil when he saw half dozen paparazzi taking pictures of Kanye, but Chantre said there was one who stood out.

"There was one paparazzi in particular that was kind of saying some stuff," Chantre recalled.

  • Kanye:?"What you're trying to do is get me in trouble so I step off and then have to pay you $250,000."

Despite predicting the outcome, Kanye still went after Dano, who went down as the pair struggled for the camera. Kanye got into a waiting car while the paramedics were called for Dano.

"They put him in a wheelchair and he had his leg all stiff, but I don't think something happened," Chantre said. "I truly believe he was faking."

Christian Zimmerman works with Dano and says the video he recorded is "selling like crazy."

"Our photographer did nothing wrong and if this goes to court, Kanye will be in a lot of trouble," Zimmerman said.

The Los Angeles Police Department is investigating the fight.

The success of social media such as Facebook and Twitter has masked the lack of technological breakthroughs in the past decade, according to one of Britain?s leading scientists, who is to be announced today as the recipient of the world?s oldest scientific award.

Sir Andre Geim, who shared the Nobel Prize in Physics in 2010, said that he regarded most social media platforms as ?utterly time-wasting?.

How should alts fit into college savings plans?

Advisers should prioritize investment mix and flexibility when pondering which college savings plans are right for clients, according to J.P. Morgan Asset Management, which runs New York's adviser-sold college savings plan.

In advice the firm is publishing later this month, J.P. Morgan suggests that advisers examine whether plan investments extend beyond stocks and bonds. Alternatives like real estate, and emerging-markets and high-yield bonds are attractive additions.

Advisers should make sure the allocations in clients' 529 plans ? even fixed-income allocations ? are diversified. Such diversification helps mitigate duration risk and generate more income, the firm said in an early copy of ?Evaluating 529 Plan Investment Portfolios.?

?The 529 has become the premier way to save for college and it's a great tool for advisers, but many folks think that they all look alike,? said Michael Conrath, 529 program director for J.P. Morgan. ?They may seem like it at the high level, but not all 529s are created equal.?

Americans have about $166 billion invested in the nation's 86 different 529 plans, according to Morningstar Inc. Investments in the plans, which are sponsored by states, grow tax-free as long as the funds are spent on college expenses.

Only a handful of firms offer alternative investments in Section 529 plans, according to Paul Curley, director of Strategic Insight's college savings plan research. Those include the New York plan with J.P. Morgan investments and New Mexico's adviser-sold plan Scholar'sEdge, which added alternative investments in May.

J.P. Morgan also recommends that advisers examine whether the investments in college savings plans are tactically managed, allowing the managers flexibility to make important adjustments to take advantage of opportunities or avoid risks, Mr. Conrath said.

He said this feature, not found in many 529s, is especially important because investors are legally allowed to make changes to their investment options only once a year.

The three pages of recommendations also include making sure plans offer glide paths that fit with clients' risk tolerance and that portfolios include a mix of funds with low correlation to each other.

Although the written guidance doesn't mention performance, Mr. Conrath said families are using these plans to try to accumulate enough dollars to combat rising tuition and fees and performance must be examined.

?As a parent, I want to look at who is actually managing the money for my three kids,? Mr. Conrath said. ?I want to know how the 529 has performed and whether this manager oversees similar portfolios in other spaces, such as retirement, and have those portfolios delivered in other areas.?
